Terms of Use
These terms are the agreement between you and Jaber El Ferkh for using the Nova Numbers iPhone app and this website. Installing or using the app means you accept them.
1. This agreement
“We”, “us” and “our” mean Jaber El Ferkh. “You” means the person using the app. If you do not agree with these terms, please do not use Nova Numbers.
Nova Numbers is distributed through the App Store, so Apple’s Standard End User Licence Agreement also applies. Where these terms and Apple’s EULA disagree about the licence to use the app, Apple’s EULA wins.
2. Who can use it, and who agrees to this
Nova Numbers is an educational practice app for children aged roughly 4 to 14, intended to be set up and supervised by a parent, guardian or teacher.
You must be 18 or older, or the age of majority where you live, to accept these terms, install the app, and make any purchase in it. By setting the app up for a child you confirm you have the authority to do so and that you accept these terms on their behalf.
The Grown-ups area, the legal documents and the subscription screen reached from the lesson map sit behind a parent gate. It is a barrier against accidental taps, not a security control, and it does not replace your supervision.
3. What the app is, and is not
Nova Numbers generates short arithmetic questions from the skill each lesson teaches, reads handwritten answers on the device, and tracks stars and progress. It is practice material, and it is not a curriculum, a tutor or a substitute for teaching.
Specifically, the app does not:
- provide a formal, standardised or diagnostic assessment of a child’s maths ability;
- identify a learning difficulty, or suggest a child has one;
- replace a school curriculum or the judgement of a teacher;
- guarantee any particular educational outcome.
The Skills Check places a child at a sensible starting difficulty. Treat its result as a starting point, not a verdict.
Handwriting recognition is experimental. It misreads answers sometimes, which is why the app shows what it read and always offers a typed answer instead.
4. Answers and progress
Handwritten answers are read on the device and discarded after each question. They are never saved, shared, or used to train anything. Progress, stars and settings are stored only on the iPhone — we have no server and no copy of them.
Deleting the app removes everything it stored. There is no export, because there is no account and nothing to move. See the Privacy Policy for the detail.
5. Premium subscriptions
Nova Numbers is free to use. The free app includes the Skills Check, the whole world the child is placed on, and five lesson starts a day. Nova Premium is an optional auto-renewing subscription that opens all four worlds and removes the daily limit. The free features stay free and are not removed if you do not subscribe.
- Billing. Payment is charged to your Apple Account when you confirm the purchase. Prices are shown in the app before you buy, in your local currency, and are set in App Store Connect.
- Renewal. The subscription renews automatically for the same period unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours of the end of that period.
- Free trial. Where a free trial is offered, any unused part of it is forfeited if you buy a subscription during the trial.
- Managing and cancelling. Open Settings on your iPhone, tap your name, then Subscriptions. Cancelling stops the next renewal; you keep Premium until the end of the period you have already paid for.
- Refunds. Purchases are made from Apple, so refunds are handled by Apple under its own terms. We cannot issue a refund for an App Store purchase. Request one at reportaproblem.apple.com.
- Price changes. If a price rises, Apple will notify you and ask for your consent before the new price takes effect, as its rules require.
6. No advertising
There is no advertising in Nova Numbers — no banners, no interstitials, no rewarded video, and no third-party advertising SDK. Nothing about a child is used for advertising or profiling, and we do not sell or share data with data brokers. The only purchase in the app is the subscription described above.
7. Acceptable use
You agree not to:
- copy, resell, rent or redistribute the app;
- reverse-engineer, decompile or tamper with it, except where law allows it regardless of this term;
- work around the paywall, or use the app in a way that breaks the App Store’s terms;
- use it for anything unlawful.
8. Ownership
We own the app, its source code, its lesson content, and its original artwork — including the mascot Orbi, the planets and the worlds. You get a personal, non-transferable, non-exclusive licence to use it on devices you own or control, under Apple’s EULA. Nothing here transfers ownership to you.
9. Availability and changes
We may update the app, change or remove features, or stop distributing it. We will not knowingly remove a feature you have paid for during a period you have already paid for. If the app is discontinued, it keeps working on your device for as long as your iPhone and its iOS version allow, and your data stays where it has always been — on the device.
10. Disclaimers
The app is provided “as is”. To the fullest extent the law allows, we make no warranty that it will be uninterrupted, error-free, or fit for a particular purpose, that handwriting will always be read correctly, or that using it will produce any particular improvement in a child’s maths.
11. Liability
To the fullest extent the law allows, we are not liable for indirect, incidental or consequential loss arising from your use of the app, and our total liability for any claim is limited to the amount you paid us for the app in the twelve months before the claim.
Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you, and you may have rights under local consumer law that these terms do not affect.
12. Apple
Apple is not a party to these terms and has no obligation to provide support for the app. Apple is not responsible for the app or its content, and is not responsible for any claim you have about it — including product liability, a failure to meet a legal requirement, or a consumer-protection claim. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
13. Ending this agreement
You can end it at any time by deleting the app, which also removes the data it stored. We may end it if you materially breach these terms. Sections 8, 10, 11 and 14 survive.
14. Governing law
These terms are governed by the laws of Morocco, without regard to its conflict-of-law rules. If you are a consumer, you keep the protection of the mandatory laws of the country you live in, and you may bring proceedings in your local courts where local law gives you that right.
